Welcome to iLive Connect. This privacy policy (‘Privacy Policy’) is a crucial document to your use of our Services and, therefore, it is important to clarify whom we are talking about:
iLive Connect is the owner and publisher of the website titled www.iliveconnect.com on the world wide web as well as the underlying software, services and mobile applications provided by iLive. The services rendered through the website and the mobile application are collectively referred to as the “Services”.
At iLive, we take our data protection obligations seriously and ensure that your data is well guarded and protected when utilizing our software. iLive Connect also ensures that it is compliant with all applicable laws, including but not limited to (i) Information Technology Act, 2000; (ii) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011; (iii) Information Technology (Intermediary Guidelines and Digital Media Ethics) Rules, 2011; and (iv) The Digital Personal Data Protection Act, 2023.
We respect your privacy, and will not share, sell, or otherwise disclose your personal information to disclose this information to affiliates, subsidiaries, agents, or third party content providers for marketing purposes. We retain the right to disclose any information necessary to normal business operation, such as to payment processors.
This Privacy Policy details how we collect, use, share, disclose and safeguard your personal information while using the Services.
BY USING THE SERVICES OR BY OTHERWISE GIVING US YOUR INFORMATION, YOU WILL BE DEEMED TO HAVE READ, UNDERSTOOD AND AGREED TO THE PRACTICES AND POLICIES OUTLINED IN THIS PRIVACY POLICY AND AGREE TO BE BOUND BY THE PRIVACY POLICY. YOU HEREBY CONSENT TO OUR COLLECTION, USE AND SHARING, DISCLOSURE OF YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY. WE RESERVE THE RIGHT TO CHANGE, MODIFY, ADD OR DELETE PORTIONS OF THE TERMS OFTHIS PRIVACY POLICY, AT OUR SOLE DISCRETION, AT ANY TIME. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY AT ANY TIME, DO NOT USE ANY OF THE SERVICES OR GIVE US ANY OF YOUR INFORMATION. IF YOU USE THE SERVICES ON BEHALF OF SOMEONE ELSE (SUCH AS YOUR CHILD) OR AN ENTITY (SUCH AS YOUR EMPLOYER), YOU REPRESENT THAT YOU ARE AUTHORISED BY SUCH INDIVIDUAL OR ENTITY TO (I) ACCEPT THIS PRIVACY POLICY ON SUCH INDIVIDUAL’S OR ENTITY’S BEHALF, AND (II)CONSENT ON BEHALF OF SUCH INDIVIDUAL OR ENTITY TO OUR COLLECTION, USE AND DISCLOSURE OF SUCH INDIVIDUAL’S OR ENTITY’S INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY.
1. Privacy Policy Overview:
i. This Privacy Policy sets forth the following:
(a) The nature of information collected from Users, including Personal Information and Sensitive Personal Data or Information relating to an individual;
(b) The purpose, means and modes of collection, usage, processing, retention and destruction of the information; and
(c) Reasons behind disclosure of the information.
2. Collection of Personal Data
i. In order to protect User Data, our Services can only be used upon creation of a user account. To create a user account, we will require and will process the following data points:
(a) Email address;
(b) Password;
(c) iLive ID (post registration);
(d) Registration Date;
(e) Status of consents;
(f) Language, country and time zone;
(g) IP address; and
(h) Financial Information such as bank account, debit card, credit card details or other payment information.
ii. When you access the Services, or interact with us via emails, telephone calls, video calls or other correspondence, we may ask you to voluntarily provide us with certain information that personally identifies you or could be used to personally identify you. You hereby consent to the collection of such information by iLive. Without prejudice to the generality of the above, information collected by us from you may include (but is not limited to) the following:
(a) contact data (such as your email address and phone number);
(b) demographic data (such as your gender, your date of birth and your pin code);
(c) data regarding your usage of the services and history of the appointments made by or with you through the use of Services;
(d) insurance data (such as your insurance carrier and insurance plan); other information that you voluntarily choose to provide to us (such as information shared by you with us, including, but not limited to, past prescriptions and health related details).
The information collected from you by iLive may constitute ‘personal information’ or ‘sensitive personal data or information’ under the SPI Rules.
“Personal Information” is defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person.
The SPI Rules further define “Sensitive Personal Data or Information” of a person to mean personal information about that person relating to:
(a) passwords;
(b) financial information such as bank accounts, credit and debit card details or other payment instrument details;
(c) physical, physiological and mental health condition;
(d) sexual orientation;
(e) medical records and history;
(f) biometric information;
(g) information received by body corporate under lawful contract or otherwise;
(h) visitor details as provided at the time of registration or thereafter; and
(i) call data records.
iLive will be free to use, collect and disclose information that is freely available in the public domain without your consent.
In addition to the above, the following information is also captured by the application for supporting the patient needs:
(a) SSID/BSSID : This is used for checking the status & strength of Wifi Signals and determining the best possible way for rendering the information.
(b) Bluetooth: This is used for relaying the audio of voice and video calls to Bluetooth enabled speakers
(c) Camera: This is used to allow capture of patient records, displaying patient information during a video call
(d) Images, Files: These are used for for accessing the images/docs so that patient can upload documents or images and share them with the doctor
(e) Audio: This is required for accessing mic for using the video call and for cases where patient may want to speak instead of typing
(f) GPS location: Location is required for fetching address (for availability of services) & emergency ambulance requirements.
3. Privacy Statement
All iLive Users:
The applicability of this section shall extend to all Users of the services offered by iLive.
i. In order to access the iLive Services, each user must accept and acknowledge the Terms of Use, which includes the acceptance of this Privacy Policy. Any User that does not agree with any provisions of this Privacy Policy has the option to discontinue the Services provided by iLive immediately.
ii. All the information provided by a User, including Personal Information or any Sensitive Personal Data or Information, is voluntary. You acknowledge and understand that iLive may use certain information of yours, which has been designated as Personal Information or ‘Sensitive Personal Data or Information’ under the SPI Rules, (a) for the purpose of providing you the Services, (b) for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, (c) for communication purpose so as to provide You a better way of booking appointments and for obtaining feedback in relation to the Practitioners and their practice, (d) debugging customer support related issues, (e) for the purpose of contacting you to complete any transaction if you do not complete a transaction after having provided us with your contact information in the course of completing such steps that are designed for completion of the transaction. iLive may also use the information provided by You for the following purposes: (a) Identifying You; (b) Publishing such information on the Website; (c) Contacting Users for taking product and Service feedback; (d) Analyzing software usage patterns for improving product design and utility; (e) Analyzing anonymized practice information for commercial use; [IRC2] (f) Processing payment instructions including those through independent third party service providers such as payment gateways, banking and financial institutions, pre-paid instrument and wallet providers for processing of payment transaction or deferral of payment facilities.
iii. By accessing and using the mobile application and/or verifying your contact number with iLive, You have explicitly consented to receive all above stated communications (through call, SMS, email or other digital and electronic means) from iLive and/or its authorized representatives, even if your contact number is registered under the DND / NCPR list under the Telecom Commercial Communications Customer Preference Regulations, 2018. For this purpose, the required information may be shared with third-party service providers or any affiliates, group companies, and their authorized agents.
iv. Collection, use and disclosure of information which has been designated as Personal Information or Sensitive Personal Data or Information’ under the SPI Rules requires your express consent. By affirming your assent to this Privacy Policy, you provide your consent to such use, collection and disclosure as required under applicable law.
v. You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of account registration. If your personal information changes, you may correct, delete inaccuracies, or amend information by making the change on our member information page or by contacting us through contact@iliveconnect.com. We will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable. If you provide any information that is untrue, inaccurate, out of date or incomplete (or becomes untrue, inaccurate, out of date or incomplete), or iLive has reasonable grounds to suspect that the information provided by you is untrue, inaccurate, out of date or incomplete, iLive may, at its sole discretion, discontinue the provision of the Services to you.
vi. If you wish to cancel your account or request that we no longer use your information to provide you Services, contact us through contact@iliveconnect.com. We will retain your information for as long as your account with the Services is active and as needed to provide you the Services. We shall not retain such information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force. After a period of time, your data may be anonymized and aggregated, and then may be held by us as long as necessary for us to provide our Services effectively, but our use of the anonymized data will be solely for analytic purposes. Please note that your withdrawal of consent, or cancellation of account may result in iLive being unable to provide you with its Services or to terminate any existing relationship iLive may have with you.
vii. iLive may require the User to pay with a credit card, wire transfer, debit card or cheque for Services for which subscription amount(s) is/are payable. iLive will collect such User’s credit card number and/or other financial institution information such as bank account numbers and will use that information for the billing and payment processes, including but not limited to the use and disclosure of such credit card number and information to third parties as necessary to complete such billing operation. Verification of credit information, however, is accomplished solely by the User through the authentication process. User’s credit-card/debit card details are transacted upon secure sites of approved payment gateways which are digitally under encryption, thereby providing the highest possible degree of care as per current technology. Please note that iLive provides the User with the option to not save payment details on the App, however, such decisions are completely at the User’s option and iLive shall not be responsible for the use of such data.
viii. The Website uses temporary cookies to store certain (that is not sensitive personal data or information) that is used by iLive and its service providers for the technical administration of the Website, research and development, and for User administration. In the course of serving advertisements or optimizing services to its Users, iLive may allow authorized third parties to place or recognize a unique cookie on the User’s browser. The cookies however, do not store any Personal Information of the User. You may adjust your internet browser to disable cookies. If cookies are disabled you may still use the Website, but the Website may be limited in the use of some of the features.[IRC3]
ix. iLive shall not sell, rent or otherwise give your e-mail address to a third party without your consent.
x. iLive has implemented best international market practices and security policies, rules and technical measures to protect the personal data that it has under its control from unauthorized access, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss. However, for any data loss or theft due to unauthorized access to the User’s electronic devices through which the User avails the Services, iLive shall not be held liable for any loss whatsoever incurred by the User.
xi. Other than as specifically stated in this Privacy Policy, iLive will only disclose your Personal Information in the event it is required to do so by law, rule, regulation, law enforcement agency, governmental official, legal authority or similar requirements or when iLive, in its sole discretion, deems it necessary in order to protect its rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk, or to enforce or apply the Terms of Use.
4. Processing Of Data for Product Improvement
If you consent, we also process your User Data beyond the necessary usage described in Section 3 to improve our Services as described in more detail below.
i. Purpose of product improvement: We have to continually analyze, develop, test, and improve our products, in order to ensure that our content benefits users in the most effective way. To do this, we analyze usage and incorporate learnings into improved new versions of our products. These improvements are also provided to you via regular updates.
5. Usage For Statutory Purposes
i. Scientific research and statistics: User Data can also be used for the purposes of research and statistics (always whilst complying with the recognized ethical scientific standards) and internal analyses. This anonymous data is used mainly to determine and improve the effectiveness of techniques for controlling and treating various illnesses.
ii. Enforcement of rights: The use of personal data may also be necessary to prevent abuse by users or to assert, exercise, or defend legal claims. We may be forced into disclosure due to binding laws, court or official decisions and instructions, criminal investigation, or in the public interest. In such cases, the storage and processing of your data is permitted by law without your consent.
6. Storage and Retention
i. User Data is stored on the device being operated by the User. User Data is also stored on servers operated by iLive and servers operated by third-parties for the limited use of providing services to iLive.
ii. iLive shall only store User Data for the duration of your contract with iLive. In certain cases, longer storage may be required in order to fulfill post-contractual obligations or to comply with statutory storage obligations or disclosure duties or to assert, exercise or defend legal claims (subject to limitation periods).
7. Third Party Suppliers
i. iLive may use third parties to provide products, services or in any manner support the offering of Services by iLive or collaborate with such third parties to develop or promote the Services offered by iLive. Due to this, iLive may be required to disclose the User Data to such service providers or third parties. However, such disclosure shall be strictly limited to the information necessary for such third parties to provide their services to iLive.
ii. iLive shall ensure that the User is able to review the privacy policy of such third parties, as each third parties privacy policy shall govern their use of the User Data. The User can also review the list of third parties being engaged by iLive, including their privacy policy, by accessing the following link here.
iii. In the occasion of a change in ownership, sale, merger, liquidation or reorganization of iLive, either in whole or in part, your information may be transferred as part of such transaction, including during the due-diligence process, so long as the party receiving such information shall agree to be bound by the terms of this Privacy Policy.
iv. iLive may also release the User Data to third parties as may be required by law or to protect the safety, rights or property of Users, the public or iLive or defend iLive and any of its officers, directors, employees, attorneys, agents, contractors and partners, in connection with any legal action, claim or dispute.
8. Data Protection Officer
i. Our data protection officer is available to answer all data protection questions at contact@iliveconnect.com. The data protection officer monitors compliance with all data protection regulations and is subject to strict statutory secrecy and confidentiality obligations.
ii. The data protection officer is widely involved in all questions associated with protecting the personal data of our users.
9. Changes
i. Data protection legislation in India is constantly evolving and being developed, and, as a result, iLive will have to mandatorily undertake changes from time to time. iLive will inform you of the changes by appropriate means whilst granting an appropriate advance notice period and, if necessary, obtaining new consents. iLive will not reduce a User’s right under this Privacy Policy without the User’s explicit consent.
ii. Unless otherwise provided by this Privacy Policy, the same term definitions apply as in our Terms of Use.
10. User Rights
i. Revocation of Consents: Users have the right to revoke the consent at given to iLive at any time. However, this will not affect the lawfulness of the processing prior to the User’s revocation. Services provided by iLive may be impacted and/or restricted as a consequence of such revocation.
ii. Deletion (Right to be forgotten): Every User has the right to request the deletion of their personal data. To do so, please contact iLive at contact@iliveconnect.com.
iii. Correction: In the occasion that a User finds that some of the User Data is incorrect, then in such case the User can request iLive to ensure that such data is corrected. In most cases, the User will have the ability to update and change such User Data by themselves.
iv. Complaints: If a User has any complaints on the protection of the User Data or any portion of this Privacy Policy, then please contact us at contact@iliveconnect.com or contact our Data Protection Officer at contact@iliveconnect.com.
11. User Consent to this Privacy Policy
You categorically acknowledge that this Privacy Policy is a part of the Terms of Use for Services offered by iLive, and you unconditionally agree that becoming a User of the Services offered by iLive signifies your assent to this Privacy Policy and consent to iLive using, collecting, processing and/or disclosing your Personal Information in the manner and for the purposes set out in this Privacy Policy. It is reiterated that your use of the Services offered by iLive is subject to this Privacy Policy and the Terms of Use.
